We abide by consumer law and fair consumer collection practices

The Fair Debt Collection Practices Act (FDCPA) is a federal consumer protection law that prohibits debt collection companies from using abusive, unfair or deceptive practices to collect debts from you. The FDCPA applies only to consumer debt and does not cover business debt.

The FDCPA states the hours and methods, including by letter, in which consumers can be contacted by debt collection agencies. It also defines what the debt collector must tell you about the debt when they contact you, which is the following:

  • How much money you owe
  • The name of the creditor to whom you owe the money
  • What to do if you don’t think the debt is yours.

Additionally, the law says that when consumers are represented by attorneys, debt collectors who are informed of this must communicate with the attorney, so long as the attorney responds in a timely manner. Please let our firm know if you are represented by an attorney.
